Unfair Dismissal

If you have been dismissed without your employer having a fair reason for dismissing you or did not follow the correct process when dismissing you or you were dismissed for an automatically unfair reason (such as discrimination) you may have been unfairly dismissed.


An employer has the right to dismiss you for reasons related to your conduct (such as substance abuse or theft), ability to do your work (performance related) or long term illness.

The most common situations of unfair dismissal are:

  • exercising your statutory employment rights and a request such as (but not restricted to):
  • not to be discriminated against because of your gender, race, disability, religion or belief, sexual orientation or age
  • maternity, paternity or adoption leave
  • a payslip
  • a minimum notice period
  • the right to request flexible working arrangements
  • protection against unlawful deductions from wages
  • being paid during suspension on medical grounds
  • whistleblowing
  • before, during or after business transfers
  • unfair selection for redundancy
  • on the grounds of pregnancy or maternity rights
  • in connection with disciplinary or grievance hearings
  • relating to your working time
  • relating to the National Minimum Wage (such as requesting it or reporting your employer for not providing it)
  • relating to trade union reasons (such as being or refusing to be a member of one)
  • relating to activities as an employee representative
  • for taking action on health and safety grounds
